Terms and Conditions of Use

Please read the following terms and conditions of use for the Concept2, Inc. Logbook (the “Logbook”), which may be accessed online at log.concept2.com. By creating an account on the Logbook, you acknowledge that you have read, understood and agreed to these Terms and Conditions of Use. If you do not agree with these terms and conditions, please do not use the Logbook and exit the Logbook’s website immediately.

Concept2, Inc. (“Concept2”), together with its subsidiaries, are collectively referred to in these Terms and Conditions of Use as “'we,” “'us,” “our,” or other similar pronouns.

  1. Privacy Policy. We respect your privacy. Our collection, use and disclosure practices regarding your personally identifiable information are set forth in our Privacy Policy. Please take some time to review the Privacy Policy (available at concept2.com/company/internet-policies/privacy). By creating an account on the Logbook and using the Logbook, you agree to the terms of our Privacy Policy.

  2. Eligibility. By using the Logbook, you represent and acknowledge that your use of the Logbook and your agreement to these Terms and Conditions of Use does not violate any law or government rule applicable to you. Certain Logbook features may be disabled for users under 18 years of age for their protection or as otherwise required by U.S. law.

  3. Logbook Community. Concept2 allows users to establish Logbook accounts as a service to our customers and to the community. In the spirit of sharing useful information among Logbook users, we ask that you only post accurate and truthful information to the Logbook, including profile information and workout data. Please treat all other users of the Logbook with respect.

  4. Athlete Performance. Using any method to gain an unfair advantage or entering false or erroneous information is not allowed. Athletes who are suspended by a recognized anti-doping organisation will not be able to race or set records during the period of their suspension. Concept2 reserves the right to remove records or results of any athlete.

  5. User Content. If you post any information, including workout, team, gym and biographical information, messages, pictures, and other content (“User Content”), and a third party makes any claims, suits or demands upon us alleging that we have violated their intellectual property rights with respect to that User Content, you agree to indemnify and hold us harmless against any such claims, suits or demands. Please do not upload any User Content that you do not own.

    By submitting User Content to the Logbook, you authorize us to treat the User Content as non-confidential and non-proprietary and allow us to reproduce, reuse or modify the User Content in any manner and in any location or medium of our choosing. However, you will retain your intellectual property rights in your User Content and you may adjust your privacy settings within the Logbook to limit the visibility of your User Content and we will honor your privacy settings.

  6. Limited Use; Disclaimer. Except for any User Content, all content on the Logbook and otherwise available through the Logbook, including designs, logos, artwork, text, graphics, images, data, information, software, interactive features, application programming interfaces and other files (the “Logbook Contents”), is owned by Concept2 or its licensors. You may freely use any of the Logbook Contents for your own personal purposes, but may not use any Logbook Contents for any commercial purposes without Concept2’s prior written consent. Please note that we do not make any warranty of the accuracy of any of the information contained in the Logbook. We also cannot promise that the Logbook Contents are suitable for any purpose. We cannot be held liable for any damages or costs you may incur by using or relying on any Logbook Contents or any User Contents submitted by you or any other Logbook user.

  7. Backups. Although we currently intend to continue offering the Logbook to the Concept2 community, we cannot guarantee that we will support the Logbook indefinitely. We encourage you to download and save your User Content for your records.

  8. Prohibited Uses. You are prohibited from violating or attempting to violate, any security features of the Logbook. You agree you will not do any of the following (or attempt to do any of them):

    1. Access any content or data not intended for you, or log onto a server or account that you are not authorized to access;

    2. Probe, scan, or test the vulnerability of the Logbook or the Concept2 website, or breach security or authentication measures;

    3. Interfere with service to any user, host or network;

    4. Use the Logbook to send unsolicited e-mail or other communications, including, without limitation, advertisements for products or services; or

    5. Impose an unreasonable or disproportionately large load on our infrastructure.

  9. Termination. We reserve the right to terminate your use of the Logbook and to terminate your Logbook account if you post any materials that we deem inappropriate, or otherwise violate these Terms of Use. We may access and/or terminate your account if we receive complaints from other users of the Logbook that you are interacting with them in a manner we deem to be inappropriate.

  10. Governing Law. The Terms of Use are governed by the laws of the State of Vermont without respect to its conflict of laws principles. The Logbook is controlled and operated by Concept2 from its offices within the State of Vermont, United States of America.

  11. Changes to the Terms and Conditions of Use. Concept2 may change these Terms and Conditions of Use without prior notice. If the Terms and Conditions of Use are changed, we will post the modified Terms and Conditions of Use to the Logbook website. By continuing to use the Logbook, you agree that your use of the Logbook will be subject to any modified Terms and Conditions of Use.
